When a property owner comes to us with a condemnation case, we recognize that it is often the most significant legal issue that he or she will ever have.  From the moment a case comes in the door, our sole focus is to maximize the property owner’s recovery for the taking.  Our attorneys have significant experience in litigating against state, county, and local governments and private entities that have been delegated the power of eminent domain.  Our representations have involved residential, commercial, industrial, ranch, special purpose, and vacant land taken for roads, highways, drainage, flood control projects, and a variety of easements, including pipelines and high-voltage electric transmission lines.

As head of the firm’s Condemnation practice, Charles McFarland frequently lectures on eminent domain and land use issues and has written numerous articles dealing with condemnation and land use issues.  He is the editor of the Annual Review for the American Bar Association’s Section of Litigation Committee on Condemnation, Zoning, and Land Use.  We are located in downtown Houston but have handled condemnation cases across the State of Texas. 

We are constantly aware that the condemnation case represents the property owner’s one and only opportunity to recover for the taking of its property and any impacts of the taking on the market value of the property.  As appropriate to the economics of each case, our lawyers work with appraisers, land planners, and other professionals to carefully assess the market value of property and the impact of a public project, giving rise to the property owner’s claim for compensation.  The coordination of these efforts is extremely important to the overall goal of maximizing the property owner’s compensation.
