Our lawyers have represented clients in a wide range of business disputes. We have a strong concentration in the real estate and financial services industries and significant experience in a broad range of other industries. Some of our experience includes:
Lender / borrower disputes and work outs

We have extensive experience in disputes between lenders and borrowers, in sorting out loan defaults and planning a strategy to maximize lender recoveries. We have represented national banks, regional banks, loan servicers, hedge funds, individual lenders, and borrowers in matters involving real estate secured loans, personal property secured loans, letters of credit, guaranties, assignments of leases and rents, and subordination agreements.

Condemnation and Land Use Litigation
Charles McFarland has established an excellent reputation representing private property owners and business owners in eminent domain and condemnation matters, inverse condemnation matters, and property rights issues in courts across the State of Texas.

Business and Commercial Litigation

Our lawyers represent clients in a wide variety of commercial and business disputes, including claims over contracts, fraud, misrepresentation, and statutory regulations in industries ranging from wholesale distribution, web-based retailed sales, construction, shipping, and manufacturing.

Real Estate Litigation

We represent buyers, sellers, landlords, tenants and other parties in disputes arising out of virtually every form of real estate transaction. Our clients include individuals, real estate investment trusts, developers, real estate agencies and brokers, investors, associations, and builders.

Financial Institutions Litigation

Our lawyers have handled disputes for banks, finance companies, mortgage companies, loan servicers, insurance companies, and others involved in banking and consumer finance disputes.

Appellate

Our lawyers provide representation and advice on a wide variety of appellate matters, whether the goal is to reverse an adverse judgment or to protect a favorable judgment. Our appellate cases have included foreclosure and lien priorities, condemnation, business-related contractual disputes, business torts, products liability, construction contracts and defects, insurance coverage, employment discrimination and harassment claims, eminent domain and inverse condemnation, statutory claims, and securities regulation.

Securities Litigation

We have defended issuers and officers against claims they violated the securities laws. Many securities cases are resolved by motion practice or settlement. We have tried a class action securities claim to a jury verdict and favorable judgment in US District Court in Houston.

Class Actions

Our lawyers have successfully represented clients in class actions at both the federal and state level.

Construction Litigation

Our lawyers have represented construction and architectural design firms, contractors, sub-trades and material suppliers, governmental agencies, real estate development companies, and owners of real estate portfolios in complex construction contract disputes.

Insurance Coverage Litigation

Our lawyers have handled disputes for insurers and insureds involving rights and obligations under insurance contracts.

Bankruptcy Litigation

Sometimes our lender representation involves matters in bankruptcy court. We have tried claims in bankruptcy court and understand how to deal with claims that involve this forum.
